Birthday arrest: Yelling, lunging, kicking deputies, spitting on one’s face, report says

LADY LAKE, Fla. (TND) — A woman “yelling profanities and causing a disturbance” with three sheriff’s deputies standing by had to be taken outside to speak to a fourth.

It turned out to be a lesson on how not to celebrate a birthday for a woman who’d been convicted on similar charges twice before.

The call was for “a drunk pedestrian complaint” last Thursday evening, Jan. 25, at a Johnny Rockets restaurant in Florida.

“While speaking with the defendant outside,” a female deputy wrote in her arrest report said, “she threw her drink into the shrubbery and refused to pick up her empty cup and lid, after being asked several times to do so.

“The defendant began singing loudly and getting in close proximity to [another deputy’s] face, then getting within close proximity of my face, continuing to yell random utterances.

“I asked the defendant several times to back up, to create space between her and I as a precaution.

“The defendant then lunged towards me, to which at that point myself and assisting deputies to control of both left and right wrist to place the defendant in wrist restraints.

“The defendant attempted to pull her left arm away while placing her in wrist restraints.

“Due to the active resistance of the defendant, I assisted the defendant to the ground on her stomach to gain control and continue to place her in wrist restraints.”

The arrest report continued with authorities trying to search the suspect, Janey Lyn Bingham, for contraband.

One of the deputies “stood with the defendant while I was conducting the search of her person.

“While searching the defendant, they kicked [the other deputy] with her left foot.

“While searching the defendant’s shoes for contraband, the defendant kicked me in the thigh with her left foot.

“Continuing the search of her person, I was emptying miscellaneous objects from the defendant’s bra on the right side of her person, when she lunged towards me, spitting saliva on the left side of my face.

“The defendant was then placed in the rear of my patrol vehicle.”

But it wasn’t over yet.

“While searching the defendant’s purse for contraband before being transported to the detention center, I heard the defendant striking the rear of my patrol vehicle.

“I observed the defendant kicking the passenger rear window.

“I removed the defendant for my patrol vehicle and assisted her to the ground on her stomach,” while a corporal helped “with placing the defendant in a HOBBLE position, to prevent the defendant from causing damage to my marked patrol vehicle.”

On her 33rd birthday, Bingham was charged with two counts of battery on a law enforcement officer, resisting without violence — yes — and disorderly intoxication.

Online records show she was booked on Jan. 25 at 8:39 p.m., her bail was set at $12,000, but she has not been released from jail.

According to the arrest report, Bingham had been convicted of battery in 2014 and of battery on a law enforcement officer in 2022. Neither of those occurred on her birthday.
