BIG PINE KEY, Fla. (TND) — A man visiting his stepfather in the Florida Keys is accused of attacking him with a coral rock.

The 60-year-old victim had “two lacerations on his forehead, as well as some lacerations on his left arm,” according to the arrest report from Friday afternoon, Feb. 16.

He told Monroe County deputies in his front yard, “He was pushed to the floor and hit by a coral rock that” his stepson, Newton Auer Brungart, “was holding on to.

“[The victim] stated after being knocked down and attacked, that Newton walked away from the residence.”

Memorandum of No Action, filed Feb. 27, 2024. by Lenny Cohen on Scribd

The 33-year-old was charged with aggravated battery with a deadly weapon and petit theft.

The arrest report did not say what caused the violence but in the next week-and-a-half, by Tuesday, his stepfather had changed his mind — decided not “to participate in this matter,” according to a Memorandum of No Action — so the state will not pursue the case.
