CLERMONT, Fla. – It seems the timing could hardly have been worse.
A man told police in Florida “he was sitting outside on the porch with another girl,” when “his now ex-girlfriend Nicolette Smith attempted to break into his apartment and then began battering him.”
One of the officers reported finding the victim “to have blood all across his face and have multiple lacerations to both of his hands,” at about 3 a.m. on Sept. 14.
The arrest report said, “Nicolette began to tear the porch lining in an attempt to enter the porch. [The victim] began trying to defend himself and [the other woman] by pushing Nicolette away from the porch screen while she attempted to climb in.
“[The other woman] eventually ran inside the residence in fear of Nicolette and locked the porch doors.
“[The victim] stated Nicolette was able to enter the porch and begin battering [him].
“[The victim] did not quite remember exactly what happened but did advise that Nicolette head-butted him in the head during the altercation.
“[The victim] stated him and Nicolette were previously dating for approximately the last year. While dating, they did not live together at a residence but did remain intimate with each other.
“When officers first arrived on scene, [the other woman] was detained because she was outside the residence at the time other officers arrived. [The victim] kept repeating that Nicolette who was currently still on the porch was the female who battered him, not [the other woman] who officers originally thought.”
Once they got that straight, one of the officers wrote, “Nicolette followed me outside of the residence and advised she was already at the residence before the incident occurred.
“Nicolette stated she came outside to the porch when she saw [the other woman] outside as well. Nicolette advised [the victim] began hitting her and at one point grabbed at her throat during the altercation. Nicolette stated the porch was already damaged before the altercation occurred, and she did not have any part in causing that damage.
“Nicolette, like [the victim], did not provide exactly what happened during the altercation between [the victim] and her. While conversing with Nicolette, I observed the odor of a sweet alcoholic beverage emitting from her breath.
“Nicolette would remain calm with officers and then would start crying while conversing. This process repeated multiple times during our conversation. I did observe Nicolette to have some blood on her lips as well as on her leg.
“Nicolette mentioned multiple times she had other bruises on her body, but I did not see them. I also did not observe any visual markings on her neck where she alleged she was grabbed.”
Paramedics were called to check on Smith.
While she was being examined, “[The other woman] completed a sworn written statement and stated she was in fear for her life as Nicolette attempted to enter the residents through the porch. … She corroborated with what [the victim] said, stating she and him were outside on the porch smoking a cigarette when Nicolette arrived at the porch.
“[The woman] explained Nicolette began breaking the porch lining and entering the porch while [the victim] began protecting her, trying to get her out of the porch.
“When Nicolette completely entered, [the woman] advised she left the porch and locked the porch doors inside of the residence due to Nicolette’s behavior. [The woman] added that she did not witness the altercation.”
The officer described the porch, seeing “multiple glasses to be broken as well as what appeared to be a plate crashed on the floor. The porch chairs were moved and glass was on the floor of the porch deck. The porch lining where [the victim] and [other woman] said Nicolette entered from was torn and Nicolette’s phone was found outside of the porch on the ground in the bushes.”
At this point, police said the victim “refused to complete a sworn written statement and did not wish to prosecute on Nicolette entering his residence without permission and her tearing his porch screen. … [The victim] mentioned he did not wish Nicolette to be arrested at that time and would not elaborate further on unknown details during the altercation.”
Eventually, the parties refused to be treated, despite both having “minor apparent injuries,” so paramedics left the scene.
In the end, police said Smith “was the primary aggressor,” so she was arrested for battery-dating violence.
The arrest report said she was “transported to the Lake County Jail without incident,” but she was not booked until almost 4 p.m. There’s also no explanation for what appears to be a hospital gown in her booking photo.
Smith, 37, was released in lieu of $1,500 bond after 25 hours in jail.
