Suspect in girl’s molestation ‘doesn’t remember,’ would’ve been ‘blackout drunk’ if he did it, cops say

PORT CHARLOTTE, Fla. – A girl “at a friend’s house” over Thanksgiving weekend told a terrible story about what someone in her home “has been doing to her over the last year.”

Now, that man is charged with two felony sex crimes, and he’s being held without bond.

The affidavit from the sheriff’s office in Florida said the victim told an adult “about how Kenneth [Gary Fehr] has been touching her breasts and vagina inappropriately. The victim also included Kenneth has been penetrating her vagina with his fingers and using his ‘thing.’

“[A deputy] asked … what his ‘thing’ meant,” and wrote in the report that the “victim expressed both penile and digital penetration by Kenneth to both her vagina and anus.”

Authorities took the victim to the sheriff’s office headquarters, where a detective from the Major Crimes Unit and a “special interviewer” for “the sexual nature of this investigation” spoke to her.

“It should be noted that during the interview,” the report said, “the victim did not use anatomically correctly [sic] identification of body parts, instead referring to them by nicknames. These parts were confirmed as their correct anatomical body part by use of forensic dolls. For the clarity of the reader, all body parts will be referred to by their anatomically correct name.

“During the interview, the victim described how Kenneth would commonly get drunk. During these times, Kenneth would come into the victim’s room, sometimes while he thought she was sleeping, and other times while he knew she was awake. Kenneth would take the victim’s clothes off, and his, and proceed to perform sexual acts on, or cause her to perform sexual acts on him, while in her bed. 

“The victim elaborated on these sexual acts to include penile and digital, Kenneth’s pointer finger, penetration of her anus and vagina. The victim described these actions as hurting when they occurred. At one point during the interview, the victim used an anatomical doll to correctly identify male and female genitalia. The victim proceeded to use the dolls to demonstrate how Kenneth would sit her on his lap, while naked and face him, and ‘hump’ her, which she demonstrated as he thrusting motion.

“The victim also described how Kenneth would forcefully place her hand on his penis and ‘shake it,’ which was consistent with the act of masturbation. During this time, a white ‘slime’-like substance would come out of Kenneth’s penis, and some would get on her hands. Kenneth would then use hand sanitizer to clean it up. The victim described Kenneth as having black hair around his genitals. 

“Kenneth will also forcefully give the victim a chewable melatonin, and recently an unknown white oval-shaped pill. The victim does not know what the white pill is, and added that she would hide it in her mouth, and then spit it out in the bathroom.

“The victim stated that these incidents started occurring around November of 2023, and last occurred approximately two months ago. The victim estimates these took place approximately 18 to 20 times.”

The affidavit also says the suspect’s mother later showed up at sheriff’s office headquarters and said in a sworn recorded statement, “She has been living with the victim and her son, Kenneth, for the last four months. [The mother] stated she has never seen Kenneth interact with his children inappropriately, but was told by [someone] about these allegations.”

She spoke with two others, and the affidavit continued, “While Kenneth did not admit to doing the actions, he never denied them. Kenneth told her and the rest of the family that he does not remember if he did or not, due to him being blackout drunk if he had. Kenneth said he doesn’t remember doing anything, but knows that the victim would not lie about this, and that he would get help.” 

Then, in a follow-up statement, the affidavit said authorities were told, “Kenneth repeatedly tried to deflect the allegations and blame it on his drinking problems, saying he would be blackout drunk if these allegations were true.”

The age of the alleged victim is not included in the report, but Fehr, 38, is charged with two counts of lewd or lascivious molestation by an adult, with the victim being 12 years of age or younger.

He has been in jail since his Dec. 1 arrest. Since then, he has pleaded not guilty.

Despite the felony charges calling for no bond, the judge issued an Order of No Contact.

Prosecutors, on the same day, filed a Motion for Pretrial Detention to make sure Fehr stays locked up, writing, “There are no conditions of release or bail which will reasonably protect the community from risk.”

Fehr’s criminal history includes a battery charge from August 2023. Details are not available, but Fehr had been on a pre-trial diversion program.

The pre-trial diversion that started in May was supposed to last a year. Despite that, neither the judge nor prosecutors from Fehr’s older case brought up his more recent arrest. That case is still considered closed.
