EUSTIS, Fla. – A 50-year-old man living with his parents is being held without bond after two arrests for domestic battery this year. His alleged victims were his girlfriend and his elderly father.
Police officers met his father outside their home in Florida after the more recent incident.
“He stated his son Robert Roy had gotten upset and smacked him in the head and pushed him,” the arrest report from Dec. 7 said. “[The victim] stated the incident began as an argument about the care of his wife, [name], while in the care of hospice. He stated Robert became upset when he explained it was hospice, and not him, that is giving her medicine.
“[The victim] advised Robert pushed him up against the vehicle that was parked in the driveway, and smacked him in the head with his hand. When asked when this incident occurred, he stated approximately two hours prior to him calling law enforcement. When asked why he didn’t call when it occurred, he stated Robert left on foot, and when Robert called to ask for a ride back to the house, he told them no.
“[The victim] stated Robert said he was going to come back to the house and destroy his vehicle. [The victim] advised he’s in fear of what might happen, so he decided to call law enforcement. [The victim] advised this is not the first time Robert has been violent, and he will no longer put up with it. [The victim] advised he wished to prosecute, and provided a written statement.”
Authorities noted the victim is 85 years old.
The arrest report also mentioned “an independent witness” who approached
and told officers, “They witnessed Robert become upset with [the victim] and throw water on him, and push him in the chest. This individual advised that Robert has been violent and unpredictable in the past, and requested to remain anonymous.
“Officers canvassed the surrounding area for Robert to no avail,” but they’d find and arrest him a few hours later.
The incident in late March involved his girlfriend, her son, and a gun, and it was more adult-oriented.
Police showed up at the home and said Roy told them, “He got into an argument with his ‘on and off girlfriend of about six months,’ [name]. After the argument, she left to walk to the store. Upon returning from the store, [the victim] gathered her things and waited on the patio sofa for her son, [name], to arrive.
“Upon [the son’s] arrival, Robert stated that [the son] brandished a firearm and held it level with his waist while pointing at Robert. [The son] then demanded for Robert to release his mother, and accused Robert of ‘beating her a**.’ Robert denied the allegation. [The victim] grabbed her belongings; then got into [her son’s] vehicle.
“According to Robert, once [the victim] entered the vehicle, [the son] began walking backwards towards his vehicle while still pointing the firearm at Robert. Robert admitted to walking towards [the son] and following him to his vehicle. Robert advised that he was afraid for his life at first, but once [the son] began to walk away, Robert no longer feared for his life and, in fact, began approaching [the son] because as Robert advised: ‘if he was going to shoot me, he would have already done it.’
“Robert described the firearm.” He also described the circumstances that led up to the victim wanting to leave.
“Prior to the argument, Robert and [the victim] had sexual intercourse right after [the victim] showered, during which, [the victim] asked Robert to choke her with her towel that she was wearing. Robert advised he did so because ‘she’s freaky’ and likes stuff like that. Robert also advised that she usually asks him to use her shirt just choke her. Robert advised that nothing has ever gotten physical between the two besides sexual intercourse. Robert did not have any unusual coloring on his hands or fists.
“It should be noted, several times throughout my interaction with Robert,” an officer wrote, “he spontaneously uttered the following: ‘that boy is going to end up dead and in a trash can,’ ‘I’m going to beat his a**,’ and ‘I’m going to hop in my parents car and take care of him once this is through.’”
Meanwhile, two other officers spoke to the victim and her son at a different location for their take.
“[The victim] advised that she has been ‘seeing’ Robert for almost a year and today, he ripped her shirt off, kicked her, kneed her in her face, spit on her, and put a towel around her throat. Robert then punched her in the face, at which point [the victim] ran out of the door and Robert tackled her.
“[The victim] managed to reach her phone and message her son, [name], that Robert was hurting her. [The son] then showed and asked ‘if he was going to let her out.’
“Robert then let her out; then proceeded to follow [the victim] and [her son] to the car while cussing and spitting on them. [The victim] advised she and [her son] were able to drive away and call police.
“According to [a corporal], she observed several bruises and scratches on [the victim] to include: a scratch on her right elbow, bruising on her front right forearm, dirt on her left arm and elbow from her being tackled; underneath her right eye was slight swelling, and bruising was beginning; bruising beginning to form on her right leg, slight redness on her right thigh, and slight redness on the left side of her neck.
“When asked about this, [the victim] advised that right before [her son] arrived, Robert was choking her to the point where her breathing was restricted and almost ‘blacked out.”
Finally, the son showed officers the text messages he got from his mother: “Help, Come get me, I can’t type please come please, help now I need help come.”
He got to the house and found his mother “on the floor and Robert at the door. [The son] advised when his mother saw him, she ran around Robert and went outside. [The son advised that Robert began cussing, spitting, and getting ‘very close’ to [the son], [the victim], and his vehicle. At which point, [the son] drew his pistol on Robert and gave commands for Robert to back up away from them. Eventually, [the son] and [the victim] were able to get into the car and drive away to call police.”
There were no cameras around to capture anything on video, but two other people saw part of what happened.
“[The son’s] girlfriend was in the vehicle at the time, but was not involved further,” the arrest report said, and Roy’s mother – the one now in hospice care – “arrived on scene and requested that everyone involved be trespassed from her home at [address]. Unfortunately, [the victim], [her son], and [his girlfriend] had left prior to being trespassed.
“Ultimately, Robert was placed into custody and” taken to jail.
On March 25, he was charged with domestic battery by strangulation and spent 21-and-a-half hours locked up until his release in lieu of $2,500 bond.
On Dec. 7, Roy was charged with domestic battery on a person 65 or older. He spent the next five days behind bars, when the judge ordered his bond from March revoked.
Roy has been in jail ever since.
