Senior ‘squishing and hurting’ real estate agent in her car, wouldn’t let her leave: ‘All she has to do is move over’

LADY LAKE, Fla. – Selling a home can be emotional but the relationship between an owner and his real estate agent turned violent in her car.

It was like they played Musical Chairs after a showing in Florida on Jan. 10, but it was no game.

“The defendant was sitting on her and not allowing her to leave,” the arrest report said. “The victim stated the defendant was ‘squishing and hurting’ her.

“A male voice was heard in the background, which was later identified as the defendant, stating ‘all she has to do is move over.’”

That may sound like something a child would say, but it came from a 90-year-old senior citizen.

A sheriff’s deputy wrote about finding Robert Jack Smith “sitting halfway inside the vehicle on the driver’s side. The victim was seated inside the vehicle in the driver’s seat.

“The defendant stated that he simply wanted to talk to the victim, but she didn’t want to engage, and was trying to leave. I advised the defendant that he needed to exit the vehicle, and that he could not prevent the victim from leaving.”

The victim was more than a Realtor to Smith. There was a relationship, which was redacted in the arrest report. The two have different last names, and county records show her name is not listed on the title of his home.

She told the deputy she was showing Smith’s house when he arrived.

“After her clients left,” the arrest report continued, “the victim attempted to leave as well, but was unable to, due to the defendant standing in front of the driver’s side door.

“The victim then walked around the vehicle and entered through the passenger’s side, crawling into the driver’s seat.

“She stated that the defendant then opened the driver’s side door, jumped on top of her, and prevented her from driving away.

“The victim reported that the defendant elbowed her in the upper left arm and shoved his body into hers. When he refused to stop, she called 911.”

Smith reportedly told the deputy he went home “to try and talk to the victim. The defendant stated the victim attempted to leave, and he became frustrated, so he opened the vehicle door and sat in the driver’s seat.

“The defendant stated the victim came into the vehicle through the passenger’s side and tried to move him out of the driver’s seat. The defendant stated he never put his hands on the victim, and never would.”

A neighbor was also at the scene.

He “was called over to be a witness when the altercation began,” though the arrest report does describe that in any detail. “[The neighbor] stated that the defendant wanted to talk to the victim, but she did not want to speak with him.

“According to [the witness], the defendant got into the driver’s seat of the victim’s car, while the victim entered through the passenger side.

“[He] described both the defendant and the victim attempting to push each other out of the driver’s seat. He also mentioned that he videotaped part of the incident.”

The deputy reported it showed “the victim sitting in the driver’s seat, and the defendant partially in the seat as well. It should be noted I did not observe any pushing between the parties.”

Nothing else was written about Jan. 10. 

The arrest report simply picks up the next day, with the deputy going to a different home, a few miles away, with no apparent connection to either party in this case, “to attempt to make contact with the defendant.”

Smith reportedly told the deputy, “He realizes that him sitting in the driver’s seat in the victim’s car was to keep her from leaving, and he shouldn’t have done so.”

The nonagenarian ended up charged with domestic battery and trespassing. 

His bond was set at $4,000 and he was released after 20 hours in jail. He was also ordered to have no contact with the victim.
