Shoplifting suspect found ‘passed out and unresponsive’ after 2 violent episodes in patrol car

FRUITLAND PARK, Fla. – A woman wanted for some minor shoplifting — less than $10 worth of items from a convenience store — is facing two felonies and four misdemeanors after a trip to the hospital and jail.

An employee at a 7-Eleven in Florida told police, “There was a female inside the business who had stolen items from the store,” on Aug. 31, her arrest report said. “The items were described as a bottle of Listerine and a package of candy.”

The employee also said she was “carrying a blue bag” and “got into a black Lincoln Town Car.”

Officers pulled a traffic stop and reported “an immediate odor of marijuana coming from the vehicle,” then Yvette Marie Miller saying “she did not take anything from the store.”

A sergeant asked Miller if either she or her passenger, apparently her boyfriend whose first name was not listed in the arrest report, had a medical marijuana card. “Miller stated she did, but did not have it on her.

“[The sergeant] then observed a half-smoked marijuana cigarette sitting near the center console cup holder, at which point he requested Miller and [her passenger] to exit the vehicle, at which point they complied.

“As Miller was exiting the vehicle, she spontaneously uttered that she was ‘sorry’ and stated she was involved in a theft at 7-Eleven and wanted to go back and pay for the items.

“Miller stated the stolen items were inside of her backpack in the back seat.”

That led to “a probable cause search of the vehicle,” the arrest report said, and the sergeant reported finding “the blue backpack in the rear passenger compartment under several items of clothing.

“Within the backpack, [the sergeant] located the stolen bottle of Listerine mouthwash, as well as a stolen bag of Planters mixed nuts.

“Inside of the backpack, [the sergeant] also located a wallet containing Miller’s identification card, a black zipper pouch with ‘Ms. Parker’ written on it, a glass vial containing 4.5 yellow bar-like tablets marked ‘R039,’ a glass jar containing a green leafy substance, and two 9mm rounds.

“Upon opening the black zipper pouch, [the sergeant] observed several narcotic smoking devices and a plastic baggie containing a clear crystal-like substance.” 

At this point, the arrest report notes, “Miller stated numerous times that the bag did not belong to her and she was just ‘using it,’ even though her identification was within.

“Also, [the passenger with the last name Parker] stated he and Miller were in a relationship and the black zipper pouch was labeled ‘Ms. Parker.’” He was not arrested.

Then, the arrest report said, “Miller initially denied ownership of the located contraband but later stated it was hers, ‘I guess.’”

As for the other items, the crystal-like substance reportedly field tested presumptive positive for methamphetamine, the green leafy substance field tested presumptive positive for marijuana, and the yellow bar-like tablets were positively identified as alprazolam.

Miller was arrested and going to face five criminal charges but she got a sixth added after some incidents in the officer’s patrol car.

“While en route to the jail, Ms. Miller began to kick and punch the back windows and screen, eventually getting out of her handcuffs,” the officer wrote.

“I had to pull over and call for assistance as Ms. Miller became violent.

“Once the assistance arrived, she was again placed back in the backseat with her handcuffs on behind her back, and leg cuffs to keep from kicking.

“Approximately five minutes down the road, I had to again pull over and call for assistance from neighboring officers.”

But Miller — who’s listed as 5’8” tall and weighing 140 lbs. — wasn’t headed to jail, at least not yet.

“While waiting for officers,” the officer continued, “I stood at a window and was told by Ms. Miller she needed EMS. I explained she could be seen once we got to the jail.

“Leesburg officers arrived and as we opened the door, Ms. Miller was ‘passed out’ and unresponsive.

“EMS was then called and when they arrived, she was transported to [an] emergency room.

“Once Ms. Miller was evaluated, she was then transported to the Lake County Jail.” That was after 10 the next morning.

The arrest report ended by noting, “The total amount of merchandise was $8.48. The Listerine was $5.49 and the Planters nuts were $2.99.”

Miller, 36, was charged with possession of alprazolam, possession of methamphetamine, possession of a small amount of marijuana, possession of drug paraphernalia, resisting without violence, and her original charge: petit theft.

Her bail was set at $8,500 and she has not been released.
