OCALA, Fla. – The babysitter’s boyfriend did it.
That’s what authorities in Florida determined after a young boy’s mother
said he’d “disclosed to her and her husband that when he was six years old, adult suspect Anthony Kincer ‘made him get naked and touched his penis.’ This incident was reported to have occurred at the victim’s babysitter’s house, located at [address]. The victim’s babysitter is [name] and the suspect is her former paramour.”
The news came to light in August when the mother said “she had walked into the victim’s bedroom and found him with his pants around his ankles, standing with his younger sister.”
The arrest affidavit continued, “She asked the victim when this happened, and he disclosed to her that he didn’t know exactly when, but sometime around when he was six years old.”
The next week, a Special Victims Unit detective “arranged for the victim to participate in a forensic interview” at a safe space for child abuse victims.
“During the victim’s interview,” the affidavit said, “he explained that he came to Kimberly’s Center because of ‘Anthony’ (suspect). He explained that the suspect has been in jail for hitting [name], his babysitter, and he’s a ‘bad guy’ because he touched his [victim’s] penis. When asked where his penis was, the victim gestured to the front part between his legs.”
The affidavit said it happened “once,” at the babysitter’s house, “at night, when everyone was asleep. The victim” was lying on the couch “in the living room, trying to sleep. The suspect snuck out of his bedroom and got onto the couch. Then, the suspect told him to take his clothes off. The victim told him no. The victim recalled he was wearing…
“Then, the suspect pulled his leg and pulled down his shorts and underwear, and grabbed [h]is penis with his hand. Initially, when asked what he felt when the suspect grabbed his penis, the victim indicated he didn’t know. Later, when asked if the suspect’s hand was moving when he grabbed his penis, the victim nodded his head yes. …
“The victim illustrated this by making a fist with his hand and gesturing with a pulling motion. When asked if he said anything to the suspect when the suspect grabbed his penis, the victim explained that he kept telling the suspect to stop, and the suspect kept telling him no.”
After that, the affidavit said, “He recalled hearing a video game playing. The suspect told him not to tell [the babysitter] about what happened. Then, the suspect told him he would get him some hot fudge, and he brought him some fudge in a mug. Then, the victim told the suspect to stop, and to turn the video game off. Then, the victim pulled this pants and underwear back up, and he went to sleep. The suspect went back to bed.”
“The victim recalled that he was six, almost seven years old when this incident happened. He recalled that he was in kindergarten at the elementary school across from his house at the time.” The affidavit described the time as “between 09/03/2022 and 09/03/2023.”
The suspect’s relationships with both the alleged victim and the babysitter had been deteriorating.
“She confirmed that the victim would sometimes stay the night at her house when she babysat him,” the detective wrote. “He would either sleep in her children’s bedroom or on the couch. She explained that the victim was always happy when he came over to her house, until around the time that the suspect started staying with her. Then, ‘things changed.’
“[The babysitter] explained that she and the suspect started dating in July 2022, and around August or September 2022, he moved into her house. She explained that their relationship was good at first, but then it began to deteriorate. She described a history of domestic violence between them that spanned most of 2023, with each of them being arrested for allegations of violence against the other. [The babysitter] explained the suspect also threatened to beat her and her children, threatened to kill her, and threatened to kill himself if she ever left him. To her knowledge, the suspect never threatened violence toward any of the children she watched. Her relationship with the suspect ended around August 2023.
“[The babysitter] recalled that when the victim first met the suspect, they were fine and they got a long, initially. Then, around January 2023, the suspect started causing problems with her and her children. She recalled that the victim started to dread coming over to her house, and he expressed that he did not want to come over anymore. [The babysitter] recalled that the victim was ‘terrified’ of coming back over. Even when her relationship with suspect ended, and the suspect moved out, the victim still did not want to return to [the babysitter’s] house without significant assurance that the suspect was never coming back.
“[The babysitter] explained that it seemed like the victim was ‘targeted’ by the suspect. She explained that out of the seven kids she babysat at her house, the victim was the suspect’s ‘least favorite’. She explained that the victim is very hyper and active, and he doesn’t listen well, which aggravated the suspect. [The babysitter] explained that the victim didn’t like the suspect, and she initially assumed it was because the suspect yelled at the victim and the other children that she babysat. She did not witness any other negative behavior between them. To her knowledge, the victim and the suspect didn’t get into any fights or arguments with one another.
“[The babysitter] explained that the suspect currently lives” somewhere else, with his new girlfriend.
She also mentioned sexual abuse allegations involving a 15-year-old girl, which the detective researched and wrote about in detail. The detective reported in the end, the girl’s father “filed a petition for protection against repeat violence on behalf of [the teen], which was denied and closed due to insufficient evidence.”
Kincer was arrested “for a domestic battery” in February 2023, apparently involving the babysitter, and he was arrested again the next day for “a violation of a pretrial release condition.”
It was the second charge that had him serving time.
At some point, prosecutors decided not to pursue the battery charge, and there’s no record of it online.
As for the violation, the victim’s name is redacted from the arrest report but it said she’s the “ex-living [sic] girlfriend, and she stated that the suspect, Anthony Kincer, was arrested yesterday for a domestic battery.
“She stated that he contacted her from jail after the no contact order was filed in court. Suspect contacted her twice, one at 1537 and 1809. The second time he called, I was present,” a deputy wrote. “The automated call came in and stated that suspect’s name.”
The deputy “confirmed the existence of the pretrial release conditions” and “then arrived to the Marion County Jail to interview the suspect.
“Post Miranda, he stated that he had a piece of paper with various numbers. On that piece of paper was the victim’s number. He stated that he was calling all of those numbers today, in hopes to contact a bails bondsman. The suspect mentioned that he must of [sic] accidentally called her since it was on the list.
Kincer spent almost two months in jail.
Court records also show “domestic relations/family” cases filed against Kincer by the babysitter in February 2023 and by the boy’s mother in August 2024. Both were “closed” and neither had documents available with details.
Finally, the detective in the boy’s case “located the suspect” and wrote,
“Throughout the interview, the suspect was defensive and agitated. As soon as I began to explain why I wanted to speak with him, he cut me off and stated, ‘I know what this is all about, I have no idea what the hell they’re talking about,’ referring to the victim’s family. He denied that he has ever been alone with the victim. He advised he hasn’t seen the victim in about two years, and that he doesn’t know where the allegation came from.”
On Sept. 18, authorities got an arrest warrant. It was served the next day in Hillsborough County, where Kincer, 38, lives.
Five days later, he was returned to Marion County to face a charge of lewd or lascivious molestation of a victim under age 12. He’s being held without bond and has a court date set for Jan. 28.
