Follow-up Friday: 1st arrested for sex with underage girlfriend, now charged with battery on her

EUSTIS, Fla. – The teenager charged with lewd or lascivious battery on his underage girlfriend after her mother caught him under the sheets is back behind bars, charged with doing something else to her.

Police in Florida were called “to a verbal altercation in progress” outside a home on the morning of Dec. 8.

A sergeant reported seeing the couple, writing in an affidavit, “The female was visibly upset, and the male was holding onto the female by the sleeve of her sweatshirt near her shoulder area.

“The male and female were separated and later identified as Darius Monroe (18 YOA) and” his 17-year-old girlfriend.

“As [the sergeant] was separating the couple,” the affidavit said, “[the girlfriend] stated Darius was hitting her, and Darius accused her of lying.”

Another officer arrived and spoke to the girlfriend. That’s when the sergeant “noticed Darius began to look around and tighten his clothing. Due to this behavior being consistent with individuals that flee from law enforcement, [the sergeant] positioned himself on the other side of Darius.”

That didn’t work.

“Darius then fled on foot northbound through the tree line,” the affidavit said, “and officers gave chase. The foot chase was terminated … due to losing sight of Darius after he began running.”

Somebody sitting at a nearby intersection tried to help.

He told officers “he saw Darius running” and “knew his parents” lived in the area, so officers “went to the residence and made contact with Darius’ stepfather. He allowed officers to check the house for Darius; however, he was not there.”

Another officer showed up and met with the girlfriend.

“She stated that she and Darius have had and on-and-off sexual relationship for approximately three years,” the affidavit said. “She said she always meets him [at that location] instead of at his residence. [The girlfriend] advised when she arrived, Darius wanted to go [look] through her cell phone and she told him no. She advised, Darius climbed over her from the outside while she was sitting in the driver seat of her [car], into the passenger seat. She stated they argued inside the vehicle and then exited and continued the argument on the side of [the house]. She stated during the argument, Darius grabbed her jaw, causing a red mark that I observed while speaking to her. She stated he then smacked her in the forehead and kicked her in the leg, causing her to fall down. While speaking with her, I did observe redness on her forehead and a red scratch mark on the underside of her jaw/neck.

“[The girlfriend] requested Lake Emergency Medical Services due to her having pain in her leg. Lake Emergency Medical Services arrived on the scene and [the girlfriend] declined to be transported to the hospital.” It wouldn’t be long for her to be overruled.

“While speaking to [the girlfriend], she called Darius on her cell phone. Darius answered, and when asked where he was, he did not answer. He asked why she called the cops on him, and she said she did not. While she was speaking to him, Darius sounded out of breath and panicked. I then heard what sounded like a vehicle door shut, and the call disconnected.”

“Due to [the girlfriend] being a juvenile, her father, [name], was contacted and arrived on the scene. [The father] advised this is not the first time Darius has been violent with [his daughter] and he wanted Darius arrested. He also requested [his daughter] to be transported to the hospital.”

Monroe, still 18, had no prior convictions for battery, but, “Due to the injuries consistent with [the girlfriend’s] story,” he was charged with simple domestic battery and resisting without violence. Those are both misdemeanors.

Four days later, he turned himself in at the jail.

That was exactly four months after his previous arrest for a felony, lewd or lascivious battery on a victim 12-16.

In that case, the girl’s mother told police “she heard a male voice in her [no age given] daughter’s room, which is across from hers, so she went to check on her daughter because there are no males that live in the residence, nor were any permitted to be there.”

The girl opened her door, which had been locked, and, “After a few moments of speaking with her daughter, she noticed her sheets from the bed were moving, and a subject appeared from the side of the bed, which was the defendant.”

The arrest report said the girl had used a sheet to sneak Monroe into her room, “by hoisting down a sheet and lifting him up to the second story through her window.”

About a month later, he was charged with a second felony: traveling to meet a minor.

Monroe also signed a No Victim Contact Order at the time of his previous arrest. His more recent arrest report makes no mention of that document.

Unfortunately for Monroe, his bond was revoked on the older charges, and he has been in jail ever since.
