Trouble with a tenant landed this elderly landlord back behind bars

FRUITLAND PARK, Fla. – A landlord has a new temporary home in jail after he tried to move a tenant he said hadn’t been paying rent. Youssef Nassief El-Masry made some other claims, as well.

“The tenants who are renting the property have not paid rent since September,” the arrest report said he told police in Florida on Dec. 21. 

“Youssef stated that he went to the Lake County courthouse and got the process for an eviction notice to be served on two occasions,” the report continued. “While in the process of completing the evictions, Youssef stated that he was in communication with the tenant, [name], and a verbal agreement was established for [the tenant] and her family to leave the property.”

El-Masry wasn’t at the property alone.

The arrest report said he told police he arrived “with his handyman and removal crew to service the property. Youssef stated that he told [the tenant] that he will be servicing the property on today’s date via phone call. Youssef stated he entered the property and began to remove items and service the property while [the tenant] was not present at the location.”

The tenant had a different story, including what she found when she returned. 

“No agreement was ever made to service the property,” the arrest report said she claimed, “nor was any confirmation in regards to be evicted on a certain date from the property.

“[The tenant] stated that when she arrived at the above address, she observed a large box truck backed into the driveway, which she believed was strange.

“[She] then observed the garage door fully opened, with the locks for the front door and laundry room door through the garage tampered with. Upon entering the property, [she] observed several of her belongings removed, and her couch in a burn pit within the backyard of the property.

“[She] advised she gave no one permission to enter the home and remove her property, and wishes to press charges.”

Finally, the officer turned to El-Masry for evidence.

“I asked Youssef if he had any emails or text messages stating the agreement for him to service the property on today’s date,” the officer wrote. “Youssef advised he did not have anything other than verbal agreement.

“I then asked Youssef if he has a copy of the eviction notice that was completed by the Lake County Sheriff’s Office. Youssef advised he has no copies.

“I then researched previous call history for this residence and observed no eviction notices served for the property.”

The officer arrested El-Masry for felony burglary, for “forcibly entering the property without any permission and removing [the tenant’s] belongings, and destroying them,” the report said.

Bond for El-Masry, 84, was set at $5,000, and he has neither paid nor been released.

This wasn’t his first trip to jail.

Records from the state show El-Masry was sentenced to 30 years of probation for insurance fraud $100,000+ and organized fraud $50,000+ that he committed in Sumter County back in 2020.

The probation was scheduled to end in 2053, when he’s 112 years, 6 months, and 15 days old.

His arraignment on the burglary charge is scheduled for Jan. 13.
